TERMS & CONDITIONS
1.0 Definitions
1.1 “Company” refers to Lift Care Services Pty Ltd
1.2 “Customer” refers to the entity purchasing parts or services from the Company.
1.3 “Parts/Services” refers to all products and maintenance or inspection services provided by the Company for disability lifts, tailgate loaders, and related equipment.
1.4 “Order” refers to the Customer’s request for Parts/Services.
2.0 Order Acceptance
2.1 All Orders are subject to acceptance by the Company.
2.2 The Company reserves the right to refuse any Order without providing a reason.
3.0 Pricing
3.1 Prices are as per the Company’s current price list or written quotation at the time of Order placement.
3.2 Prices may change without prior notice.
3.3 All prices are exclusive of GST unless otherwise stated.
4.0 Payment Terms
4.1 Payment must be made in accordance with the agreed payment terms.
4.2 If no payment terms are agreed, payment is COD (account customers: 30 days EOM).
4.3 The Company may charge interest on overdue invoices at 2 % per month.
5.0 Delivery and Service Scheduling
5.1 Delivery or service times are estimates and may vary.
5.2 The Company is not liable for delay or failure to deliver or attend a site beyond its control.
5.3 Risk in the Parts passes to the Customer upon delivery.
6.0 Returns and Exchanges
6.1 Parts may be returned within 14 days of delivery subject to the Company’s return policy.
6.2 Returned Parts must be in original packaging and condition.
6.3 The Company may refuse returns or charge a restocking fee of up to 20 % of the purchase price.
6.4 Special-order or custom items are non-returnable.
7.0 Warranty
7.1 Parts and services are covered by the manufacturer’s warranty where applicable.
7.2 The Company’s liability is limited to repair or replacement of faulty Parts, re-performance of services, or a refund of the purchase price.
7.3 No additional warranties are provided.
8.0 Liability
8.1 The Company is not liable for indirect, consequential or incidental damages.
8.2 The Company’s total liability is limited to the cost of the Parts/Services provided.
9.0 Governing Law
9.1 These terms are governed by and construed in accordance with Australian law.
9.2 Any disputes will be subject to the exclusive jurisdiction of Australian courts.
10.0 Amendments
10.1 The Company may amend these terms and conditions at any time.
